I. Government Requests

DollarPesa.com responds only to requests from government and law enforcement agencies received from government and law enforcement personnel with provision of verifying credentials of these employees.These Guidelines are provided for use by law enforcement or other government entities when seeking information about sending requests to and liaising with Dollarpesa in order to receive information on the users and their transactions.As it is stated in our Terms of Service, the services are provided by the following legal entity: registered in Seychelles.

 

II. GOVERNMENT AND LAW ENFORCEMENT AGENCIES

DollarPesa is responsible for processing law enforcement requests from all jurisdictions in accordance with the Terms of Use, privacy policy, and applicable law.

Dollarpesa accepts legally valid government or law enforcement information requests by email to Antispam Protector .

III. REQUIRED INFORMATION

For prompt consideration of information requests from authorized law enforcement officers, this request must contain the following:

  • Law enforcement agency’s name;
  • Proof that an official is authorized to request information (proof of authority) and current position in a law enforcement organization;
  • Identification card of a law enforcement organization employee (for example, badge number or internal identification number);
  • Agency issued email address;
  • Contact information (email address, phone number) from a government organization;
  • The name of the specific legal entity from which you need information;

Features of the request, including:

  • ID-agenda number in the subject line;
  • Any public addresses or transaction IDs in text format or Excel file (not PDF.);
  • Specify a reasonable time to respond;
  • Request for mutual legal assistance to ensure compliance with international law and order.

IV. EMERGENCY REQUESTS FROM GOVERNMENT AND LAW ENFORCEMENT AGENCIES

For emergency requests, i.e., when it relates to circumstances involving imminent and serious threats to the life/safety of individuals, please submit “EMERGENCY REQUEST” in the subject line.

V. DISCLAIMER/EXEMPTION FROM LIABILITY

DollarPesa.com uses all its efforts to collect and provide information to the competent authorities to the maximum extent possible, however, DollarPesa.com does not assume any responsibility and does not give any guarantees regarding the accuracy, adequacy and completeness of the information provided in response to the request. Please note that any paucity of information is possible and may be caused by any reason, including, but not limited to, the human factor, hardware and software flaws and failures.

Correspondence at the request of the competent authority is confidential and privileged and can only be used for the purposes of the request.

Requirements for submitting a legal request

In order for Dollarpesa to accept your request it must meet the following requirements:

  • Be sent by a law enforcement agency or official government entity via a registered, official email domain;
  • Include valid and enforceable legal process that compels Dollarpesa to produce the information requested, such as a subpoena, court order or search warrant;
  • Contain the name and contact information of the individual law enforcement agent or government representative who is authorized to serve the request;
  • State with particularity the categories of records or information sought;
  • Include sufficient information regarding the user, such as a phone number or email address, in order for Dollarpesa to identify the user account(s) at issue; and
  • Indicate the specific time period for which information is requested.

How Do I Submit a Request?

Acceptance of legal process by any of these means is for convenience and does not waive any legal objections, including lack of jurisdiction or proper service.

Please email [email protected] to advise you have submitted a request via mail or intend to serve in person. Requests received by mail are subject to additional processing time.

  • Does Dollarpesa notify users that a law enforcement request for information relating to them was received?

Dollarpesa reserves the right to provide notice to users before producing information related to their account unless:

  • We are prohibited by law from doing so;
  • We have reason to believe the user’s account has been compromised such that the notice would go to the wrong person;
  • We have reason to believe that notice would create a risk to safety or be otherwise counterproductive; or
  • The request is an emergency request and prior notice would be impractical, in which case we reserve the right to provide notice after the fact.

Law enforcement officials who do not want their request disclosed should provide an appropriate court order or process establishing that such notice is prohibited or provide sufficient detail for Dollarpesa to determine whether a request falls into one of the exceptions above.

 

Response Time

Dollarpesa typically responds to valid requests for information within two business weeks. However, response times may take longer than two business weeks depending on the complexity and scope of the request. If you require an expedited response, the required response deadline should be stated clearly in both the submission documentation and the formal request itself.
